How does the Probate process work?

The administration of someone’s estate in line with official specifications involves the careful completion of essential legal, tax and administrative requirements.

This includes the collection of assets and settling of debts and taxes prior to the remainder of the estate being dispersed among its named beneficiaries. As such, HM Revenue and Customs, the Probate Court, and any financial institution in which the deceased held assets will need to be contacted.

Because the personal representative is liable for the successful distribution of the deceased’s estate, it is crucial to prevent any errors being made during the process.

How long will it take?

Processing times vary according to the complexities of the estate, but Probate is usually completed within 6-9 months.
